These Terms & Conditions (“T&C”) govern all logistics and related services provided by
Eagle Logistics Solution Services (“Company,” “we,” “our,” or “us”) to its clients (“Customer” or “you”). By engaging our services, the Customer agrees to the following terms:
1. Scope of Services
- » The Company provides logistics, freight forwarding, customs clearance, warehousing, transportation, relocation, and related services as agreed with the Customer.
- » Specific services, timelines, and charges will be detailed in the quotation, invoice, or service agreement.
2. Customer Responsibilities
- » Provide accurate and complete shipment details, including documentation, permits, and licenses.
- » Ensure that goods are properly packed, labeled, and compliant with international and Saudi regulations.
- » Declare any hazardous, restricted, or high-value cargo in advance.
- » Pay all agreed service charges, duties, taxes, and additional costs as applicable.
3. Liability & Insurance
- » The Company’s liability for loss, damage, or delay is limited to the value specified under applicable international conventions (e.g., Hague-Visby Rules, CMR, or IATA rules) unless additional insurance is purchased by the Customer.
- » We are not liable for losses caused by force majeure events including but not limited to natural disasters, strikes, war, government restrictions, or unforeseen operational delays.
- » Customers are encouraged to obtain cargo insurance for full value protection.
4. Prohibited Goods
- » The Company does not accept for carriage:
- » Illegal goods, counterfeit items, or contraband.
- » Dangerous goods not declared or improperly packed.
- » Perishable items without prior agreement.
- » Valuable items such as cash, jewelry, or personal documents unless explicitly agreed.
5. Delivery & Timelines
- » While the Company strives to meet all delivery commitments, timelines are estimates and subject to customs clearance, carrier schedules, and external conditions.
- » The Company is not liable for delays outside its reasonable control.
6. Payment Terms
- » All charges must be paid as per the invoice terms.
- » Late payments may attract interest charges.
- » The Company reserves the right to withhold or delay services until payment is received.
7. Claims
- » Any claim for loss, damage, or delay must be submitted in writing within 7 days of delivery (or expected delivery date).
- » Claims must include supporting documents such as invoices, packing lists, and proof of loss.
8. Termination of Services
- » Either party may terminate services with written notice if the other party breaches these Terms & Conditions.
- » The Customer remains liable for any outstanding payments for services already rendered.
9. Governing Law & Jurisdiction
- » These Terms & Conditions are governed by the laws of the Kingdom of Saudi Arabia.
- » Any disputes shall be resolved exclusively by the courts of Saudi Arabia.
10. Amendments
- » The Company reserves the right to update or modify these Terms & Conditions at any time.
- » Customers will be notified of changes through official communication channels.
